Terms of Service for SmartList

Welcome to SmartList! These Terms of Service ("Terms") govern your access to and use of the SmartList mobile application ("App," "Service," or "SmartList"). By accessing or using SmartList, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, accessing, or using SmartList, you agree to:

• Comply with these Terms of Service
• Comply with our Privacy Policy
• Comply with all applicable laws and regulations
• Be at least 13 years old (or the minimum age required in your jurisdiction)

We reserve the right to modify these Terms at any time. We will notify you of material changes via the App or email. Your continued use of SmartList after changes constitute acceptance of the modified Terms.

2. Service Description

SmartList is a collaborative shopping list and expense management application that allows you to:

• Create and manage shopping lists
• Organize items into categories
• Collaborate with others through groups
• Track expenses and view purchase history
• Share lists and collaborate in real-time
• Attach photos and receipts to items
• Use voice input for adding items
• Access your data across multiple devices

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time with or without notice.

3. Account Registration and Security

3.1 Account Creation

To use SmartList, you must create an account by providing:

• A valid email address
• A secure password
• Your name
• Your location (country, state/province, city) - you can provide this manually or use GPS detection

During registration, GPS detection is automatically triggered once to help you quickly set your location. The detected location is only shown to you for review - you can modify any field, uncheck the coordinate checkbox to exclude coordinates, or clear all GPS data before submitting. Nothing is saved until you complete the registration form. When updating your location later in profile settings, GPS only triggers when you click the GPS button. You can also completely clear all saved location data (country, state, city, and coordinates) from your profile at any time using the "Clear Location" button.

Alternatively, you may sign in using your Google account.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring that your account information is accurate and up-to-date

3.3 Account Restrictions

You may not:

• Create multiple accounts for the same person
• Share your account credentials with others
• Use another person's account without permission
• Create an account using false or misleading information
• Transfer or sell your account to another person

4. User Conduct and Prohibited Activities

4.1 Acceptable Use

You agree to use SmartList only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others, including intellectual property rights
• Upload or share harmful, offensive, or inappropriate content
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Attempt to gain unauthorized access to the Service or other users' accounts

4.2 Prohibited Activities

You must not:

• Use automated systems (bots, scrapers, etc.) to access the Service
• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or hack the Service
• Interfere with or disrupt the Service or servers
• Upload viruses, malware, or malicious code
• Collect or harvest user data without consent
• Use the Service for spam or unsolicited communications
• Attempt to circumvent security measures

4.3 Content Guidelines

When creating or sharing content (lists, items, photos, notes), you must not:

• Upload illegal, obscene, or offensive content
• Upload content that violates copyright or trademark laws
• Share personal information of others without consent
• Post misleading or fraudulent information

5. Groups and Collaboration

5.1 Creating and Joining Groups

SmartList allows you to create groups and invite others to collaborate. When you create a group:

• You are responsible for managing group membership
• You can assign admin privileges to other members
• You control access to group lists and data

5.2 Group Member Responsibilities

As a group member, you agree to:

• Respect other members and their contributions
• Not abuse admin privileges if granted
• Not delete or modify others' content maliciously
• Follow group rules set by admins

5.3 Leaving Groups

You may leave any group at any time. When you leave a group:

• Your access to group lists and data will be removed
• Your contributions remain in the group
• You can be re-invited by an admin

6. Intellectual Property Rights

6.1 SmartList's Rights

The Service and its original content, features, and functionality are owned by AlHusso and are protected by:

• Copyright laws
• Trademark laws
• Patent laws
• Other intellectual property laws

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6.2 Your Content

You retain ownership of content you create (lists, items, photos, notes). By using SmartList, you grant us a limited license to:

• Store, process, and display your content
• Share your content with group members you designate
• Backup and secure your content
• Provide technical support

This license ends when you delete your content or account, except for:

• Content shared with groups (visible to group members)
• Backups retained for technical reasons (deleted within 90 days)

6.3 User Representations

When you upload content, you represent and warrant that:

• You own or have the right to use the content
• The content does not violate any laws or third-party rights
• The content does not infringe on intellectual property rights

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Key points:

• We collect only necessary information to provide the Service
• GPS detection is automatically triggered during signup, list creation, and shop creation for convenience, but you review and control what gets saved
• You control whether coordinates are saved via checkbox - you can save just location names without coordinates
• When updating your profile location, GPS only triggers when you click the GPS button
• You can clear all saved location data from your profile at any time using the "Clear Location" button
• We use approximate location (~100m accuracy), not precise GPS, to respect your privacy
• We use encryption to protect your data
• We do not sell your personal information
• You can request data deletion at any time
• We comply with applicable data protection laws (GDPR, CCPA, etc.)

8. Payment and Subscription Terms

8.1 Free Service

SmartList is currently provided free of charge. We reserve the right to introduce paid features or subscription plans in the future.

8.2 Future Paid Features

If we introduce paid features, we will:

• Provide clear pricing information
• Notify existing users in advance
• Allow users to opt-in to paid features
• Continue to offer basic free functionality

8.3 In-App Purchases

Any future in-app purchases will be subject to:

• Apple App Store or Google Play Store terms
• Additional terms disclosed at the time of purchase
• Our refund policy as stated at purchase

9. Third-Party Services

SmartList integrates with third-party services, including:

• Google Sign-In: For authentication (governed by Google's Terms of Service)
• Firebase Cloud Messaging: For push notifications
• Cloud Storage: For media storage

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their practices.

10. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Service will be uninterrupted or error-free
• Warranties that defects will be corrected
• Warranties regarding the accuracy or reliability of content

We do not guarantee that:

• The Service will meet your requirements
• The Service will be available at all times
• Data will not be lost or corrupted
• Errors will be corrected

11. Limitation of Liability

We shall not be liable for:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Service interruptions or downtime
• Unauthorized access to your account
• Actions or content of other users
• Damages resulting from third-party services

Our total liability to you for any claim arising from your use of the Service shall not exceed $100 USD or the amount you paid us in the past 12 months (whichever is greater).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless SmartList, AlHusso, and our affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of third-party rights
• Content you submit or share
• Your interactions with other users

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Using the "Delete Account" feature in the App
• Contacting our support team

Upon termination:

• Your account will be permanently deleted
• Your personal lists and data will be removed
• Shared content in groups may remain visible to group members
• Backups will be deleted within 90 days

13.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in prohibited activities
• We are required to do so by law
• Your account has been inactive for an extended period
• We discontinue the Service

We will provide notice before termination when possible, except in cases of:

• Serious violations
• Legal requirements
• Security threats

13.3 Effect of Termination

Upon termination of your account:

• Your license to use the Service ends immediately
• You must cease all use of the App
• Sections of these Terms that by their nature should survive will survive (e.g., indemnification, limitation of liability)

14. Modifications to the Service

We reserve the right to:

• Modify or discontinue any feature of the Service
• Change pricing or introduce new fees (with notice)
• Update the App with new versions
• Perform maintenance and upgrades

We will make reasonable efforts to notify you of significant changes, but we are not obligated to maintain or support any particular feature.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a formal claim, you agree to contact us at support@appsmartlist.com to attempt to resolve the dispute informally.

15.2 Arbitration Agreement

If informal resolution fails, you agree that disputes will be resolved through binding arbitration rather than in court, except:

• Claims in small claims court
• Claims for injunctive relief
• Claims related to intellectual property

15.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis. You waive any right to participate in class action lawsuits or class-wide arbitration.

15.4 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmartList regarding the Service.

16.2 Severability

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

You may not assign or transfer these Terms or your rights without our written consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, internet outages, etc.).

16.6 Export Compliance

You agree to comply with all applicable export and import laws and regulations when using the Service.

We welcome your feedback, suggestions, and ideas. By providing feedback, you grant us the right to use, modify, and incorporate your feedback without compensation or obligation.
